This Privacy Policy explains how we collect, use, disclose, and protect your personal information and audio assets in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
By using our services, website, or submitting files to us, you consent to the practices described in this policy.
1. Information We Collect
We collect information necessary to provide professional audio services and process business transactions. This includes:

Personal Identity & Contact Data: Name, email address, phone number, and physical billing address.

Audio Assets & Project Data: Source audio files (WAV, AIFF, etc.), track metadata, track ordering sheets, lyrics, and creative notes.

Financial & Transaction Data: Payment histories and invoice records. We do not store credit card numbers on our systems.
2. How We Collect Data
We collect data directly from you when you:

Inquire about or book a session via our website or email.

Upload audio files using our dedicated, secure payment or file-transfer channels.

Correspond with us via email, phone, or message platforms.
3. Audio Files and Intellectual Property (IP) Protection
We maintain strict confidentiality regarding unreleased audio material:

Zero Ownership: kv productions claims zero ownership rights, publishing rights, or copyright over any audio files or creative materials you submit. You retain 100% of your intellectual property.

Our IP: At times kv productions will contribute its own creative materials, audio files etc. In this case kv productions may retain ownership to those unless otherwise agreed beforehand.

Strict Confidentiality: We treat all unreleased music as strictly confidential. Files will not be shared, streamed, leaked, or distributed to any third party without your express written consent.

Staff Restrictions: Only authorized studio engineers directly assigned to your project have access to your audio files.
4. Third-Party Services and Cross-Border Transfers
To deliver our services, we share your data with trusted third-party cloud infrastructure providers. Some of these providers store data on overseas servers.

WeTransfer (Paid Subscription): We use a paid, secure WeTransfer tier to receive and deliver high-resolution audio files.

Files sent through our account are encrypted during transit and at rest.

As a paid subscriber, we utilize enhanced security features, including password-protected download links and managed expiry dates.

WeTransfer processes and stores data globally (primarily in the US and EU). By submitting files, you acknowledge this cross-border transfer under APP 8.

Payment Processors: Payments are processed through secure third-party gateways (e.g., Stripe, PayPal, or direct bank transfer). We do not see or hold your raw financial data.
5. Storage, Retention, and Security
We take reasonable steps to protect your data from misuse, loss, unauthorized access, or disclosure.

File Transfer Links: Audio delivery links generated via WeTransfer will remain active for 1 year, after which the download link expires automatically.

Studio Archives: We retain your original pre-masters and final mastered files on our secure studio local storage for up to 12 months following project completion to accommodate any future revision requests. After this period, files are purged and moved to even more secure off-line archival media. No files are permanently deleted except by agreement with you. It is not possible to 100% guarantee safety of project data indefinitely due (a) to Force Majuere events like fire, flood or war or (b) degradation of media over decades of shelf storage.

Data Breach Protocol: In the unlikely event of a data breach that causes serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by law.
6. Your Rights and Access to Data
Under the Australian Privacy Principles, you have the right to:

Request corrections to any inaccurate or outdated information.

Request the immediate deletion/purging of your personal data and audio archives from our local studio drives or offline archives.
